Kingston police arrest man on heroin charges

KINGSTON — Police arrested a man they allege sold heroin and detained another man who was in possession of a Lackawanna County Special Sheriff Deputy badge on Tuesday.

Drug agents allegedly bought heroin from Barry James Gately, 44, on Oct. 9 and 11. When police searched Gately’s residence at 380 Wright Ave., he wasn’t there.

Gately and Mark Broody, age and address unknown, entered the residence through a rear door as police were inside the house, according to charges filed.

Police allege Gately was in possession of 20 heroin packets and had planned to sell several packets to Broody, who displayed a special sheriff deputy badge from Lackawanna County.

Gately was arraigned by District Judge Paul Roberts in Kingston on five counts of possession with intent to deliver a controlled substance, three counts each of possession of a controlled substance and possession of drug paraphernalia and two counts of criminal use of communication facility. He was jailed at the Luzerne County Correctional Facility for lack of $100,000 bail.

Broody was detained by police but not charged.

Police said Broody allegedly told them that he received the special sheriff deputy badge during a ceremony by the Lackawanna County Sheriff’s Office when he was deputized as a special sheriff deputy some time ago.

Police said they are looking into Broody’s claims as a special sheriff deputy.

A criminal complaint filed against Gately alleged Broody was in possession of a syringe and other drug paraphernalia.

A preliminary hearing for Gately is scheduled on Oct. 23 before Roberts.
