3 Pa. lifers win ruling in juvenile sentence case

(AP) The federal appeals court based in Philadelphia is giving three men who have been serving life sentences since they were juveniles a fresh chance to convince judges they deserve less.


The 3rd U.S. Circuit Court of Appeals on Thursday says there's at least some reason to believe last year's U.S. Supreme Court decision throwing out life sentences for juveniles should be applied retroactively.


The appeals court is stressing its decision is tentative, and the defendants must still convince the district judges they should be resentenced.


Defendants Michael Pendleton and Franklin Baines are in Pennsylvania prisons, while defendant Corey Grant is serving life in New Jersey.


A spokesman for the Allegheny County district attorney's office says it's considering whether to appeal.


The decision notes federal circuits have split on the issue.
