NESCOPECK — A man who allegedly fled with his daughter and sparked an Amber alert in August was arraigned on charges Monday.

Court documents indicate Robert Andrew Byrne, 34, was arraigned Monday on charges of terroristic threats, simple assault and harassment before Magisterial District Judge John Hasay.

State Police in Shickshinny said they believe Ava Byrne, 3, had been abducted by her father in August. After the girl was reported missing, police issued a statewide Amber Alert and indicated they believed Robert Byrne had fled with the girl in a silver Hyundai Elantra.

According to a criminal complaint, a trooper was dispatched to a residence on Vine Street in Nescopeck for a report of a domestic disturbance. The trooper was notified while enroute that Byrne allegedly struck his girlfriend then fled with his daughter.

Byrne’s girlfriend told police he had been acting strangely for several months, and that he “has been hearing voices inside of his head.” Byrne also allegedly told his girlfriend the voices tell him when and where to go.

During the dispute, Byrne allegedly told his girlfriend she and her children were in danger and needed to leave the residence, according to the supposed voices in his head. The argument escalated to Byrne allegedly striking his girlfriend. He later allegedly threatened he was going to shoot and kill everyone and himself.

Robert Byrne is scheduled for a preliminary hearing before Hasay at 10 a.m. Nov. 9. He is currently jailed at the Luzerne County Correctional Facility for lack of $50,000 bail.
