WILKES-BARRE — The son of a Luzerne County District Judge is heading to county court to face DUI charges.

Thomas Malloy, 23, appeared before District Judge Rick Cronauer for a preliminary hearing Tuesday. Malloy waived two DUI charges onto county court, while his summary charges of accidental damage to an unattended vehicle or property and careless driving were withdrawn.

Malloy, who is the son of District Judge Thomas Malloy Sr., was arrested on Feb. 20 following a crash at West Ross and South Main streets at 1:54 a.m.

According to a criminal complaint:

Responding officers learned at the time that a man fled on foot from the scene of a crash to behind a Dollar General store.

At the scene was a black 2015 Chevrolet Silverado with damage to its right front; a silver 2007 Subaru Forester, approximately 50 feet into the intersection with moderate damage; and a gray 2008 Chevrolet Impala with left rear damage.

Officers located Malloy on South Main Street, where he allegedly said he was driving the Silverado involved in the crash. Malloy also allegedly admitted to drinking alcohol prior to getting behind the wheel.

A breath test showed that his blood-alcohol content was at .17 percent, more than twice the legal limit.

Malloy is scheduled for a formal arraignment at 10 a.m. on June 29 at the Luzerne County Courthouse. He is free on his own recognizance.
