WILKES-BARRE – A Kingston couple filed a lawsuit this week against the Jewish Community Center of Wyoming Valley after a June bicycling incident that resulted in several internal injuries.
Joseph and Devorah Leah Schulman filed the suit through their attorneys, Jonathan Comitz and Kristopher Januzzi, against the center, located along South River Street in Wilkes-Barre, alleging negligence.
The suit seeks more than $100,000 in damages.
The suit alleges that the Jewish Community Center allows no street parking on South River Street and installed posts and metal chains to block a small driveway, creating a dangerous and unsafe condition.
The driveway and its unsophisticated means to regulate vehicles from entering, exiting, idling and/or parking are not clearly marked for bicyclists, the suit says.
On June 22, Joseph Schulman was riding a bicycle on South River Street when he approached the JCC's property.
The suit says when Schulman approached the driveway, he unknowingly road his bicycle into the driveway.
The suit says the force of the impact with the obstacles was so violent, Schulman was thrown from his bicycle to the ground, and suffered a number of injuries, including fractured ribs and injuries to his pancreas, spleen and kidney.
Schulman was taken to Wilkes-Barre General Hospital for treatment, and transported by helicopter to the University of Pittsburgh Medical Center for emergency surgery.
Because of the accident, the suit says, Schulman has and will continue to suffer, and that his injuries will be permanent, causing health complications and problems for the rest of his life.
The suit alleges the JCC acted negligently by creating a dangerous condition and that the center should be monitoring, maintaining and making the area safe on a regular basis.
The suit also alleges a second count of loss of companionship for Devorah Leah Schulman because of her husband's injuries.
Devorah Leah Schulman has suffered the loss of usual companionship and has had to provide special services and care to her husband, the suit says.
