WILKES-BARRE – A man accused of firing a round into the Pittston Township tax office pleaded guilty in Luzerne County Court on Wednesday.

Michael Kozloski, 29, last known address as William Street, Pittston, pleaded guilty to aggravated assault and discharge of a firearm into an occupied structure.

Prosecutors withdrew three counts of reckless endangerment and charges of simple assault, illegal possession of a firearm, indecent exposure and possessing instruments of crime.

Judge Joseph Sklarosky Jr. said Kozloski will be sentenced Feb. 28.

Pittston Township police alleged a partially nude Kozloski fired a rifle into a private residence used as the township municipal tax office on East Oak Street on Jan. 6, 2012. The bullet struck a medicine cabinet in a bathroom and became lodged in a wall, according to the criminal complaint.

Several people were inside the building at the time of the shooting.

Kozloski aimed the rifle at an officer and ejected a live round from the gun before he was apprehended 45 minutes after the incident began, the complaint says.

Kozloski's attorney had said after a previous court proceeding that it appeared his client was under the influence of a controlled substance, possibly bath salts, a synthetic drug.

At a preliminary hearing a year ago, an assistant district attorney withdrew felony counts against Kozloski of discharge of a firearm into an occupied structure, illegal possession of a firearm and a misdemeanor count of possession of a weapon.

Shortly after the preliminary hearing, First Assistant District Attorney Sam Sanguedolce disapproved of the agreement and instructed township police to refile all charges against Kozloski.
