Testimony begins in ex-deputy‚??s civil trial

WILKES-BARRE -- Testimony is set to begin today in the civil trial of a former Luzerne County deputy sheriff who alleges her right to privacy was violated by a co-worker who videotaped her taking a decontamination shower.

Jennifer Roberts filed suit against the county and deputy sheriff Ryan Foy in 2008, alleging Foy copied and disseminated a video he had taken of her as she took a shower to rid herself of fleas that infested her body after she served a warrant on a home in 2007.

According to court records, the county said Foy was ordered by then-sheriff Barry Stankus to videotape the shower to be used later for training purposes.

Roberts alleges she suffered emotional distress and embarrassment after she learned Foy had shown the video to co-workers.

The county contends the images in the video do not rise to the level to support an invasion of privacy claim. It also disputes whether Foy disseminated the video.

Roberts lost her deputy sheriff position in August 2011 when Luzerne County commissioners unanimously voted to fire her. Wilkes-Barre police charged Roberts with harassment, simple assault and burglary stemming from a July 22, 2011 incident in which police said she harassed and assaulted the girlfriend of her former partner.

Roberts had previously been suspended without pay from her county position after a domestic dispute with her former partner, also a sheriff deputy, in February 2011.
