EXETER — A man from Tobyhanna was charged with using another man’s identity to open a bank account and depositing a $194,730 check he then attempted to withdraw.

Nolan Hileam Emory, 34, opened a bank account at the M&T Bank branch in the Midway Shopping Center using another man’s name, date of birth and Social Security number, according to court records.

Emory opened the bank account by depositing $25, court records say.

Several days after the account was opened, court records say, Emory and a woman deposited a $194,729.84 check listing the names of two people from Falls Church, Va. When the check was deposited, the woman was added to the account using a woman’s identity from Virginia.

A bank officer discovered the Social Security numbers and birthdays listed on the account did not match as the man’s identity returned a male from Hinton, WV.

As the bank delayed the release of funds from the account, Wyoming Area Regional Police was contacted and arrested Emory when he arrived at the bank to inquire about why funds were not being released, court records said.

Emory was arraigned by District Judge Michael Dotzel of Wilkes-Barre Township on four counts of identity theft, two counts of receiving stolen property, and one count each of forgery, theft and criminal conspiracy to commit receiving stolen property. Emory was jailed at the Luzerne County Correctional Facility for lack of $200,000 bail.
