WILKES-BARRE — A woman is accusing a Hanover Township company of violating the “Do Not Call List” after she says she received hundreds of nuisance phone calls.
Samantha Baker, through attorneys Brett Freeman and Carlo Sabatini in Dunmore, filed a lawsuit Thursday in Luzerne County Court against Navient Solutions LLC on Lasley Avenue. Navient Solutions processes student loans.
According to the suit:
Navient Solutions used an automated dialing system to contact Baker on her cellular phone beginning July 17, using 16 different dialing numbers.
Baker, of Lancaster County, says Navient called her at least 259 times between July 17 and Oct. 31. Navient continued to call Baker from the 16 dialing numbers despite her requests to stop calling under the federal Telephone Consumer Protection Act, also known as the “Do Not Call List.”
The suit says Navient could have taken steps to stop calling Baker but neglected to honor her requests.
Baker claims Navient invaded her privacy and caused emotional harm because she kept her cell phone’s volume turned high while waiting for calls regarding her daughter’s health.
Baker is seeking $500 to $1,500 in damages for each call Navient placed to her phone.
Navient spokeswoman Patricia Christel, who said she couldn’t comment specifically on the lawsuit, emailed the following statement:
“We are committed to following the rules to ensure student loan borrowers learn about their repayment options — some of which can be monthly payments as low as zero under federal programs.”
