WILKES-BARRE — One of the men accused in the fatal drive-by shooting of a local disc jockey was denied bail at his arraignment Friday.

David “D-Rock” Nealy, 36, is facing an open count of criminal homicide and one count of conspiracy to commit criminal homicide.

District Judge Richard Cronauer scheduled Nealy’s preliminary hearing for 9 a.m. June 16.

Nealy remained silent as he was led back into a police cruiser following the hearing. He declined to comment amid a flurry of questions from reporters.

Nealy was arrested, along with Roberto “Ruthless” Battle, 28, last week — three-and-a-half years after the fatal shooting of Michael Onley, 34, of Wilkes-Barre.

Onley, known professionally as DJ Mo, was fatally shot in the patio area of Outsiders Bar on Oct. 13, 2013. Witnesses said the gunfire originated near a silver or gray Mercedes-Benz that was traveling on nearby South Pennsylvania Avenue when Onley was killed.

Other witnesses reported seeing both Nealy and Battle in that vehicle.

The U.S. Marshals Service Fugitive Task Force arrested Battle without incident in New York City after learning of his whereabouts. Nealy is incarcerated at the Frackville state prison in Schuylkill County on an unrelated drug case.

Prosecutor Jarrett Ferentino said Battle is expected to be arraigned within the next few weeks, and he is currently incarcerated in New York pending extradition to Pennsylvania.

Ferentino believed Battle is facing unrelated charges in New York, but declined to comment further.

“We intend to move forward as quickly as we can, and bring the case and the charges to trial, and the victim’s families hopefully get justice,” said the prosecutor.
